Pre-orders Policy

This Pre-Order Policy applies to all pre-order items purchased from Dragonberry Australia (“we”, “our”, “us”). operating under Phynix Inc., New York, USA, and located at "https://dragonberry.com.au" (https://dragonberry.com.au).

By placing a pre-order, you agree to the terms outlined below, in addition to our Terms & Conditions and Returns Policy.

By accessing or purchasing from our website, you agree to accept and comply with these Terms. Please do not continue to use the site if you do not agree to all of the terms stated below

1. Definitions

Pre-Order Item: An item not currently in stock but available for advance purchase.

Dispatch Date: The date the item is scheduled to leave our warehouse.

Mixed-Cart Order: A purchase containing both in-stock and pre-order items.

Force Majeure: Events outside our control that may delay production or delivery.

2. Payment Terms

Payment is taken immediately at checkout to secure your reservation.

All pre-orders undergo fraud and payment verification screening.

Failed or flagged payments may be cancelled automatically.

Prices are charged in AUD. Currency fluctuations or bank fees are outside our control.

3. Production & Manufacturing

Estimated production and dispatch timelines are displayed on each product page.

Minor variations in color, fabric texture, stitching, or finish may occur due to manufacturing processes.

If significant changes occur, you will be notified with updated information.

If a product cannot be produced to acceptable standards, we reserve the right to cancel and refund your order.

4. Shipping & Delivery

Dispatch dates are estimates and may shift due to supplier or shipping delays.

Risk of loss transfers once the carrier collects the parcel.

We are not responsible for delays caused by:

Customs inspections

Carrier disruptions

Natural events or industrial actions

Incorrect shipping addresses provided by the customer may cause delays and additional charges.

5. Delays & Communication

We will notify you if:

production is extended,

a supplier revises delivery windows,

shipping carriers experience disruptions.

Delays do not constitute grounds for compensation.

6. Cancellations

Customers may cancel within 48 hours of purchase for a full refund.

After 48 hours, cancellation is subject to production status and may not be possible.

We may cancel a pre-order at any time for supply issues, quality issues, or failed verification. Refunds will be issued immediately

7. Returns & Refunds

Pre-order items follow the same return window as in-stock items.

Items must be unworn, unused, and in original condition.

Refunds are issued to the original payment method within the standard processing time.

8. Chargebacks & Disputes

We reserve the right to dispute chargebacks using order confirmation, tracking, and communication records.

By pre-ordering, you agree to attempt resolution with us before initiating a dispute.

Jurisdiction is governed by Australian consumer law.

9. Force Majeure

We are not liable for delays or non-performance caused by events beyond our control, including but not limited to: shipping port closures, pandemics, material shortages, natural disasters, and government restrictions

10. Data & Privacy

We collect your name, address, email, phone number, and payment details for order fulfilment and fraud protection. Your data is handled under Australian privacy regulations.

11. Changes to Terms

Dragonberry.com.au reserves the right to amend or update this Pr-orders Policy at any time without prior notice. The most current version will always be available on our website. Continued use of the site after changes are posted constitutes acceptance of the revised terms.
